Terms & Conditions for Implementation Days
By clicking the checkbox during purchase, you (“Client”) agree to retain Dynasty Group, Inc. (“Service Provider”) to proceed with technical and automation services for an Implementation Day (Full or Half-Day) (“The Service”), and agree to the terms and conditions as set forth in this Agreement.
The Service Provider agrees to:
- (1) Kick-Off Call with The Client to agree on objectives and priorities (if needed)
- Devote the time agreed to provide The Service on the date booked.
- Not accept any work from any other party for that date and time.
- Provide a wrap-up video detailing everything that was accomplished
- 7 days post-support via email and videos tutorials for technical support starting the day after The Service.
- This support covers the work completed and does not cover additional work.
- If the Client has additional work that needs to be performed, Client will have the option to book another day or a half-day Implementation Day.
Work will normally occur between the hours of 10a – 6p Pacific time on designated weekdays, but may fluctuate due to family and childcare obligations or other unforeseen circumstances.
CLIENT RESPONSIBILITIES:
The Client will be required to complete some Prep Work prior to the Kick-Off Call. The nature of this can vary and The Service Provider will provide The Client with a list of Prep Work as soon as possible after The Client books a date.
Examples of such Prep Work are: task list priorities, platform login credentials, sharing of branding assets, and sharing of content (images, emails, copy, photos, fonts).
The Client agrees to complete their Prep Work prior to the Kick-Off Call. If further Prep Work is required after the Kick-Off Call, the Client agrees to complete this prior to the date of The Service.
All assets needed to complete the project and render services must be delivered by Client by stipulated dates. If any delays impact the timeline, we will do our best to accommodate the Client, but we reserve the right to reschedule the project at our next availability, and may charge a rescheduling fee.
PAYMENT:
Payment for The Service will be to The Provider at the current rate listed on the website (yourchieftechofficer.com). Payment in full is required to reserve The Service.
CANCELLATIONS & RESCHEDULING:
This purchase is non-refundable, but may be transferred to another date or service with 7-days prior written notice.
The Client may reschedule the project one time free of charge. The reschedule date must be within 90 days of the original day booked or the client will forfeit the deposit. Additional reschedules in addition to one provided will incur a $350 rescheduling fee.
The Client's deposit is valid for 90 days, and must be used within that timeframe. In the event the intensive fails to occur within 90 days, or the Client fails to request a new date at least 7 days prior to their booked appointment, the deposit will be forfeited, and the intensive will be terminated.
If the Client wishes to reschedule beyond 90 days, the original deposit may, at the Service Provider's discretion, be applied to a new booking at the current intensive rate, which may or may not be higher than the original booking rate.
RESULTS:
There are no guarantees of number of specific finished assets, as this is a time-based intensive, not deliverables-based and client feedback + response time affect the amount of work that can realistically be completed in the time allotted. Service Provider will work as quickly and efficiently as possible and will inform Client if more time is needed to accomplish the desired goals.
The Client recognizes and agrees that the provider has made no warranties, promises, or guarantees regarding the results or revenue to be generated from entering into this agreement or the engagement of the provider. The Client agrees that any presentations, proposals, or projections made by The Provider are estimates only and do not represent a guarantee.
There are no guarantees as to the efficacy of the delivered project in terms of “conversions” or sales-generating results. Service Provider uses their best judgment based on years of experience, and information provided by client, but cannot guarantee results.
OWNERSHIP:
The results of any and all work performed by The Provider for The Client will remain the property of The Client. The Client may use this material in any way deemed appropriate.
The Client shall be responsible for determining the ownership of any intellectual property supplied by The Client to be used or incorporated into the project. The Client will fully indemnify The Provider for any damages associated with the use of any such intellectual property.
EXPIRATION
The agreement shall remain in effect for the duration of the project, or three (3) months from agreement date, or until The Client provides written notice of cancellation. This agreement may be modified or amended as necessary after negotiations initiated by either Party. If agreement is reached, only a written instrument showing both parties will modify or amend the original order.
